The Social Equity Excise Fee (SEEF) was a tax created under New Jersey’s Cannabis Regulatory, Enforcement Assistance, and Marketplace Modernization Act (CREAMMA). The SEEF is a fee that cannabis cultivators must charge on every ounce of recreational cannabis they sell. The money raised is then put toward programs designed to support social equity and help communities impacted by the War on Drugs.

While the SEEF’s intent is widely supported—helping those most affected by cannabis prohibition— the Cannabis Regulatory Commission (“CRC”) is expected to increase the current SEEF amount significantly, which is causing concern. Cultivators could face massive hikes in the SEEF, potentially up to 30 times (or 2300%) what it was initially. Instead of charging the current fee of $1.24 an ounce of cannabis, they could be required to charge as much as $30 an ounce! This could be a serious burden for businesses trying to establish themselves, and it raises questions about the industry’s long-term ability to thrive if these fees keep climbing.
So, how does the SEEF tax impact you as a consumer? If the SEEF increases, this could make cannabis less affordable, especially for people who already face higher living expenses. In short, what happens with the SEEF tax could directly impact the cost of cannabis at your local dispensary.
